TERMS & CONDITIONS

Headquarters (Pty) Ltd has been supplying professional salon and barber equipment for over 35 years. These Terms & Conditions apply to all products, sales, orders, warranties, deliveries, collections and services provided by Headquarters (Pty) Ltd (“Headquarters”, “we”, “us” or “our”).

By purchasing products from Headquarters (Pty) Ltd, the customer (“customer”, “you” or “your”) acknowledges and agrees to the terms and conditions set out below.

1. WARRANTY POLICY

1.1 Wahl Products

All warranty claims relating to Wahl machines are handled directly by Wahl South Africa (Wahl SA). Headquarters (Pty) Ltd acts only as a facilitator in assisting customers with the warranty process.

1.1.1 Five-Day Exchange Policy

Headquarters (Pty) Ltd provides a 5-day exchange policy on machines with factory faults.

Any machine believed to have a factory fault must be brought to the attention of Headquarters within the applicable 5-day period.

1.1.2 After the Five-Day Period

Once the 5-day exchange period has expired, the machine will be sent to Wahl-approved repairers for inspection and, where applicable, repair.

The timeframe for repairs is dependent on the availability of the required spare parts and is therefore not guaranteed by Headquarters (Pty) Ltd.

1.1.3 Warranty Period

All machines carry a 1-year warranty, applicable only to factory faults.

The warranty does not cover:

  • Blades;
  • Damage caused by the client;
  • Misuse or improper use of the machine; or
  • Any other damage that is not attributable to a factory fault.

A valid proof of purchase/receipt must be produced when submitting a machine for a warranty repair claim.

2. FURNITURE & CHAIRS

2.1 Chair Mechanisms

All mechanisms fitted to our chairs carry a 6-month warranty against factory defects.

The warranty does not cover any:

  • Physical damage;
  • Damage resulting from misuse;
  • Damage resulting from improper use or handling; or
  • Other damage caused by the customer or any third party.

2.2 Chair Materials and Upholstery

Due to Headquarters (Pty) Ltd being unable to control the manner in which chairs are used, maintained and cared for by our customers and, furthermore, by our customers’ own clients, no warranty is offered on the materials or upholstery of chairs.

The exception to this is where there is a clear factory defect, such as a stitching defect.

2.3 Cleaning and Maintenance

Headquarters (Pty) Ltd does not recommend the use of chemicals or detergents to clean any of our chairs.

We recommend that chairs are cleaned using clean water and a rag only.

Damage caused by the use of chemicals, detergents or unsuitable cleaning products will not be covered under warranty.

3. OTHER ELECTRONIC ITEMS

All other electronic products supplied by Headquarters (Pty) Ltd carry a 3-month warranty against factory faults only.

The warranty does not cover:

  • Misuse of the product;
  • Physical damage;
  • Damage caused by incorrect use or handling;
  • Damage caused by power surges; or
  • Any other damage not attributable to a factory fault.

4. INCORRECT INSTALLATION

Headquarters (Pty) Ltd will be free of any warranty claims relating to products where the product has been incorrectly installed by the customer or by any third party appointed by the customer.

Customers are responsible for ensuring that products are installed correctly where installation is undertaken by the customer or a third party.

5. INSPECTION OF GOODS UPON PURCHASE

All customers have the right and opportunity to inspect and check all items and goods after purchasing and before leaving the Headquarters premises to ensure that everything is in order.

Headquarters (Pty) Ltd expressly instructs all customers to thoroughly inspect all items before leaving our premises to ensure that:

  • All items purchased are present;
  • The items are in good physical condition;
  • There is no visible damage; and
  • The items are in good working order, where applicable.

Customers are encouraged to raise any concerns regarding the condition or operation of an item before the goods leave our premises.

6. WARRANTY & RETURN CLAIMS

Headquarters (Pty) Ltd reserves the right to reject any warranty or return claim where it suspects or determines that the item has been subject to:

  • Misuse;
  • Physical damage;
  • Damage caused by incorrect handling;
  • Transportation damage where transportation was arranged by the customer;
  • Incorrect installation by the customer or a third party;
  • Any other damage or circumstances falling outside the applicable warranty conditions; or
  • Fraudulent claims or attempted blackmail schemes by the customer.

All warranty and return claims remain subject to inspection and assessment where applicable.

7. DELIVERY & SHIPPING

7.1 Third-Party Courier Services

Headquarters (Pty) Ltd outsources all courier and delivery services to third-party courier companies.

All courier and delivery fees are charged to customers as an additional fee and are payable by the customer.

7.2 Delivery Information and Delays

As Headquarters (Pty) Ltd uses third-party courier companies, delivery information and estimated delivery timeframes provided to customers are based on the information supplied to us by the relevant courier company.

Any delays that may arise during the shipping or delivery of orders are outside the control of Headquarters (Pty) Ltd.

However, Headquarters (Pty) Ltd will, where reasonably possible, assist customers by obtaining information regarding the order and the status of the delivery from the relevant courier company.

7.3 Customer-Arranged Collection and Transportation

Headquarters (Pty) Ltd accepts no responsibility for orders collected or transported by couriers, Uber, or any other means of transport or courier service arranged by or on behalf of the customer, where the customer has opted to arrange their own collection.

Once the order has been handed over to the driver, courier or transport provider sent or arranged by the customer, all responsibility for the order and its transportation falls onto the customer.

This includes any loss, damage, delay or other issue occurring after the goods have been handed over to the customer’s nominated driver, courier or transport provider.

8. DISPATCHING OF GOODS

Headquarters (Pty) Ltd reserves the right to withhold the dispatch or release of any order until full payment has been received and cleared into Headquarters (Pty) Ltd’s bank account.

A proof of payment does not constitute cleared payment.

Accordingly, proof of payment will not be accepted as sufficient confirmation for the dispatch of goods where the payment has not yet reflected and cleared in Headquarters (Pty) Ltd’s bank account.

Goods will only be dispatched or released once the required payment has been received and cleared.

9. DEPOSITS & PAYMENTS

9.1 Proof of Payment

All proof of payments must be forwarded to Headquarters (Pty) Ltd through the relevant communication channels.

Customers are required to ensure that the correct payment reference is used, as instructed by their respective sales representative.

Incorrect or missing payment references may result in delays in allocating or identifying payments.

9.2 Non-Refundable Deposits

All deposits paid to Headquarters (Pty) Ltd for the purpose of:

  • Placing an order; or
  • Having stock withheld/reserved,

are non-refundable where the customer subsequently decides to cancel the order after the deposit has been paid.

9.3 Orders Unable to Be Fulfilled

In the event that stock is no longer available or Headquarters (Pty) Ltd is unable to fulfil an order for any reason, all deposits relating to that order will be refunded to the customer in full.

9.4 Cash Deposit Surcharge

Headquarters (Pty) Ltd reserves the right to charge a cash deposit surcharge on payments made by customers by means of ATM cash deposits or bank teller cash deposits.

The applicable surcharge amount will be determined based on the amount paid by the customer using the aforementioned payment methods.

Where a cash deposit surcharge is applicable, Headquarters (Pty) Ltd reserves the right to withhold the dispatch or release of the customer’s order until the applicable surcharge has been paid in full and the payment has been received and cleared into Headquarters (Pty) Ltd’s bank account.

10. TRADEMARK & USE OF COMPANY NAME

Headquarters (Pty) Ltd is a registered trademark.

Headquarters (Pty) Ltd reserves all rights in and to its name, branding, trademarks and associated intellectual property.

Headquarters (Pty) Ltd will take legal action against any person or entity that unlawfully uses its name and/or attempts to use its name for any purpose without proper authorisation.

Unauthorised use of the Headquarters name, branding or intellectual property may result in legal proceedings and any other remedies available to Headquarters (Pty) Ltd in terms of applicable law.

11. GENERAL TERMS

11.1 Acceptance of Terms

By placing an order with, purchasing goods from, or otherwise conducting business with Headquarters (Pty) Ltd, the customer acknowledges that they have had the opportunity to read, understand and accept these Terms & Conditions.

11.2 Amendments

Headquarters (Pty) Ltd reserves the right to amend or update these Terms & Conditions from time to time. The applicable Terms & Conditions will be those in effect at the time of the relevant transaction, subject to applicable law.

11.3 Applicable Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

11.4 Customer Responsibility

Customers are responsible for providing accurate information when placing orders, making payments, arranging collections or requesting deliveries. Headquarters (Pty) Ltd shall not be responsible for delays or errors arising from incorrect information supplied by the customer.

11.5 Queries and Claims

Customers are encouraged to contact Headquarters (Pty) Ltd as soon as reasonably possible should they experience any issue relating to a product, order, delivery, warranty or payment.

Nothing contained in these Terms & Conditions is intended to exclude or limit any rights afforded to consumers under applicable South African law where such exclusion or limitation is prohibited by law.

12. ACKNOWLEDGEMENT

By purchasing products from Headquarters (Pty) Ltd, the customer acknowledges that they have read and understood these Terms & Conditions and agrees to comply with the applicable provisions contained herein.
